Beijing, July 2 /Xinhua/ — A report published on Thursday by a Chinese think tank exposes legal misconceptions in Japan’s and the Philippines’ intentions to initiate maritime boundary delimitation in the waters east of the Chinese island of Taiwan.
This step, announced by Japan and the Philippines, violates international law and seriously infringes on the legitimate rights and interests of China, according to a report titled “Legal Opinion on Japan and the Philippines’ Announcement of the Commencement of Bilateral Maritime Delimitation,” published by the Institute of Strategic Studies on Marine Development under the Ministry of Natural Resources of the PRC.
In the waters east of the Chinese island of Taiwan, China, Japan, and the Philippines are maritime neighbors. The delimitation zone proposed by Japan and the Philippines largely overlaps with the exclusive economic zone and continental shelf to which China is entitled under international law, the report says.
It notes that such an action, taken without consultations with China and ignoring the specific geographical features of the region, violates the requirements of international law, including the principles of sovereign equality, duties of cooperation and self-restraint, as well as the principle of good faith, and constitutes an internationally wrongful act.
The report contains a strong call for Japan and the Philippines to immediately cease attempts to advance bilateral delimitation and to actively conduct consultations with China.
