Public consultation has begun in China on the draft amendments to the E-commerce Law of the PRC

Beijing, July 4 /Xinhua/ — The State Administration for Market Regulation of China and the Ministry of Commerce of China began collecting public opinions on Saturday on the draft amendments to the E-commerce Law of the People’s Republic of China.

The draft amendments consist of 20 provisions, including those aimed at expanding the scope of regulation of the specified law. In addition to platforms and intra-platform economic entities, the draft further clarifies the rights and obligations of other participants in the platform economy.

The draft emphasizes the need to improve the platform responsibility system. At the same time, it proposes to expand the range of regulatory tools and strengthen oversight support on a regular basis.

The draft amendments, which are also aimed at cross-sector activities in the platform economy, provide for strengthening coordination between regulatory authorities. The measures include the introduction of the principle of a unified approach to supervision of offline and online business, as well as enhancing integrated oversight based on interagency cooperation.

In order to combat serious violations in the field of e-commerce, the amendment project provides for changes and improvements to the relevant provisions, taking into account public concerns.

The project also proposes measures to deepen openness and cooperation in this sector by promoting alignment with international rules and standards, encouraging self-discipline in the industry, advancing an orderly approach to entering foreign markets, and introducing additional measures to protect the legitimate rights and interests of enterprises.

Both agencies promised to refine the draft amendments taking into account the results of public opinion collection and will facilitate the earliest possible revision of the mentioned law in order to ensure a solid legal framework for innovation and the healthy development of the platform economy.

Promoting innovation and sustainable development of the platform economy is one of the key tasks outlined for the implementation period of the country’s 15th Five-Year Plan (2026-2030). According to the main provisions of the 15th Five-Year National Economic and Social Development Program, the country will strengthen supervision over data, algorithms, traffic, and the rules of platform enterprises. It also emphasizes the need to promote mutually beneficial development of platform enterprises, intra-platform economic entities, and workers.
