Payments to creditors of a foreign bank are made by DIA from the funds of the guarantee deposit. They are transferred to the creditor’s bank account specified in his claim within 30 working days from the date of receipt by DIA of the register of claims of creditors of the foreign bank.

If there is an insufficient amount of funds in the guarantee deposit to satisfy the creditors’ claims, the funds are distributed among them in proportion to the total amount of the creditors’ claims included in the creditors’ claims register.

At the same time, in the event of insufficient collateral deposit of a branch of a foreign bank to satisfy the claims of the creditors of the DIA, a registry of creditors’ claims is sent to the foreign bank with a proposal to settle accounts with creditors whose claims have not been satisfied, at the expense of the funds of the collateral deposit. In this case, settlements with creditors will be carried out by the foreign bank.

If a foreign bank does not settle with creditors, the DIA informs the authorized supervisory body of the foreign state in whose territory the foreign bank is registered about this.
