New York, May 8 /Xin Hua/ — The US International Trade Court ruled on Thursday that the new 10-percent global tariffs imposed by US President Donald Trump are illegal, thus stripping them of validity.
The court ruled that Section 122 of the Trade Act of 1974 allows the imposition of duties only in the presence of a “major and serious balance of payments deficit.”
“However, nothing of the sort exists,” says a statement from the office of Oregon State Attorney General Dan Rayfield. “A trade deficit is not a balance of payments deficit. As the court ruled, the president’s order to impose duties is invalid and has no legal basis.”
Initially, the administration of D. Trump referred to the International Emergency Economic Powers Act (IEEPA) for the introduction of global tariffs in April 2025. In February of the current year, the Supreme Court recognized these tariffs as illegal. After that, D. Trump immediately used Section 122 of the Trade Act of 1974 and announced the introduction of a 10-percent duty on “all goods imported into the United States,” allegedly in response to the trade deficit.
Against the backdrop of the introduction of new global tariffs, a coalition of 24 American states filed corresponding lawsuits in March 2026. –0–
